San Diego Prosecutor pleads guilty to DUI

Mistakes can happen to anyone…even prosecutors.  As a former prosecutor I read cases and reflected on the fact that the people I am reading about made a bad decision rather than a bad person. I also saw in a few cases where there were points in my life my actions came close to this kind of scrutiny.  What we ask the system is to call balls and strikes.  Whoever commits the act that is deemed criminal we ask for similar treatment.  I do not wish the consequences of a San Diego DUI on anyone.  It is pretty severe.  Here is the facts about the case.

A prosecutor in the San Diego County District Attorney’s Office has pleaded guilty to a misdemeanor charge of drunk driving, the Attorney General’s Office said.

Rebecca Ocain, 37, also admitted she was driving with a blood-alcohol content greater than 0.15 percent. The admission means Ocain was driving with a blood-alcohol content about twice the legal limit.

The plea was recorded Wednesday in the East County courthouse.

Ocain was pulled over Oct. 19 near Alpine Boulevard and East Victoria Drive about 11:20 p.m. She was arrested and transported to Las Colinas Detention Facility, where she was booked on suspicion of drunken driving.


She declined to comment on the arrest and did not return an email asking about the plea.

The case was prosecuted by the Attorney General’s Office to avoid any conflicts of interest. A spokesman for the office declined to discuss the sentencing terms.

Ocain remains on staff at the District Attorney’s Office, a spokesman said Friday.

Ocain earned her degree from California Western School of Law and became a member of the state bar in 2001. She was hired by the District Attorney’s Office in 2006 and has prosecuted several high-profile cases.

In 2007, she filed charges against a former Imperial Beach fire inspector who called in death threats to city officials while drunk. He pleaded guilty to making threats, plus two counts of drunken driving.

The inspector, Edward Ernest Weiss Jr., was sentenced to rehabilitation.

Ocain said at the time that rehab, rather than jail, was warranted because Weiss had no previous criminal record and “essentially his life was spiraling out of control” because of heavy drinking.

More recently, she prosecuted a defendant who in May was sentenced to 15 years to life in prison for stabbing his estranged wife to death.
