Accidents and San Diego DUIs

I was reading the news today and ran by an article about a suspected San Diego DUI driver that hit a police car (see article below) as it was going on the wrong side of the freeway.

A San Diego DUI resulting in a collision is considered an aggravating factor in the case to the prosecution.  It is much more of a challenge for defense to obtain an offer when there is a collision.  The prosecution goes above the standard penalties for a particular blood alcohol level.   Their stance of course is reasonable IF the facts support aggravated facts.


Where this blanket policy becomes an issue is when a collision is minimal.  For example, if someone gets in a slight fender bender.  No one is hurt and the client took care of the damage before the first hearing.  These facts should not result in a bar to an offer.  Another example is when there was an accident, but there are true issues in the case (such as the client may not in fact be the driver).  The prosecution will remain steadfast in the face of questionable evidence because there was an accident.

SAN DIEGO — A woman suspected of drunken driving was arrested early Monday after authorities said she drove the wrong way on two highways and collided with a California Highway Patrol car.

Authorities were notified about 1:35 a.m. that a driver in a Mitsubishi Mirage was heading west in the eastbound lanes of state Route 52. The driver then exited onto Interstate 5 and headed south in the northbound lanes where she sideswiped the patrol car, the CHP said.

The driver was stopped and taken into custody and booked into jail on DUI charges, the CHP said.

No injuries were reported.
