Fired because of a San Diego DUI?

We have posted many articles regarding how a San Diego DUI affects professionals and their jobs.

A few highlighted teachers, nurses, and real estate agents (to name a few). 

I have handled thousands of cases that involved military, police, and other government employees.  The short answer is a San Diego DUI may or not cause someone to lose their job.

I have seen it depends on your worth in the organization.  If you are a nuclear engineer with the Navy and in good standing they will be circling the wagons for you.  If you are an average joe in the organization the “no tolerance” policies seem to come out more and you can be facing separation.

I have seen the same for police facing San Diego DUIs.  Some get it thrown under the rug with a loss of rank and pay while others are now out of the department.  In all these cases the facts can be virtually the same.  In several instances someone with more aggravated facts but they are desirable stay in.  Is it fair?  I guess the various organizations can do as they wish.  I find it interesting there is always an exception to “no tolerance” policies.

A University of Arizona police sergeant charged in February with super-extreme DUI no longer works for the school.

A UofA spokeswoman says July 1 was John McGrath’s last day of employment.

The 27-year-old McGrath had been on investigative suspension.

He was arrested Feb. 1 after crashing a police department SUV into a traffic sign while on duty.

Police say McGrath was driving the marked vehicle when he hit a sign and a concrete wall on an Interstate 10 frontage road.

Officers investigating the crash conducted a DUI investigation and police say McGrath’s blood-alcohol content was .20 percent or greater.

He was charged with super-extreme DUI, three lesser DUI charges, failure to control speed to avoid a collision and criminal damage.

McGrath had worked for the UA Police Department since 2009.
