How a San Diego DUI can affect out of state drivers

San Diego is one of the most popular tourist destinations in the United States. People from out of state come to San Diego to visit the beaches, attend conventions, and the numerous other activities that make San Diego a destination. However, someone can run into an unfortunate situation while visiting that got law enforcement involved. If this happens do not hesitate to call the Law Offices of Mark Deniz at 858-429-9982 for a free case evaluation.

CHP Video Shows State Sen. Ben Hueso's DUI Tests

"Officer is it reasonable to be scared when taking these tests?  How many test runs do you give the person (none)?  The Tests are often done in sometimes dark and cold locations right?  The tests are done when the person is driving home tired and they are jolted up by the stop and investigaation right?  The driver may be distracted by being overwhelmed by the situation right?  People in the end may just have previous injuries or bad balance to begin with right?  Do you take that into account when evaluation how they perform and the clues you are looking for?

Inside the Huddle: Shout out to the firm Team Members

Law can be so stressful and yet so fun.  Behind the closed doors we have a good time while providing the best results for our clients.  I will tell you that it can get heated though.  I had one person on the phone trying to get evidence and they are slamming their pad down.  I saw another person mad about the ruling they fought hard for in Department 12.  It shows they care and they work hard to get the best outcomes possible.

Rand Paul's Son, William, Cited for DUI

Alcohol and driving is a bad mix.  It is a grey area where it is legal up to a point.  People make unwise decisions.  They should not be judged on what is likely the worst decision of their lives.  If this young guy was in fact DUI then he will likely be held accountable.  One good thing is his family may have the resources to handle if there is any more issues other than unwise choices.

Sheriff gets his domestic violence case expunged and illustrates the process.

I was reading a recent article about the San Francisco Sheriff getting an expungement on his case.  Good for him.  It is a relief that can mean so much to someone, especially those who are experiencing the criminal system for the first time. It is a process that really closes the chapter for a lot of people.

SR 78 drivers will be stopped more for DUI

I went to the Oceanside CHP office to serve some subpoena yesterday I found out they were moving offices next week.  They are moving from Oceanside Blvd off I-5 to right off Melrose Dr on SR-78.  One byproduct if this move is even more CHP officers coming to and fro on SR-78.  This will result in an increase in citations and also DUI arrests on SR-78.  Several officers will testify that after a certain time on the weekend every stop they make is a potential DUI investigation.  It is key to remember your rights because every stop to you can be a potential DUI investigation.  Remember, it is not illegal to drink and drive.  Someone can have a a few blue moons or a glass or two of wine" It is whether someone is over .08% or impaired.  How many people will be investigated?

More reason to Avoid the 78 for north San Diego DUI cases

Pacific Beach PB "My B.A.C." aims to prevent San Diego DUI

I actually like the program. So often people feel they are less impaired than they really are. People do not realize they are impaired until they are driving. Some pull over (sometimes too late). Other times people feel they are on the way home and can soldier through. This program can allow people to gauge a little about where their BAC is at. They can recall how they felt when they did the test to give it some context.

Police Body Camera bill advancing and what is means for San Diego

I have spent virtually my entire 11 year legal career in criminal law.  I have seen a number of changes during my time as both prosecutor and now in defense.  The implementation of the body camera is one of the biggest changes I have seen (to go along with propsition 36 and 47).

Tryouts for San Diego Police K-9 Unit

K9 units is such an important part of policing.  The dogs are very powerful and can really injure a person.  The officer must know when to release the dog and that the commands are thought out.  I have seen over the years these officers grow a bond with the dogs.  The officers are usually very trained.  There is usually added salary, which is always a nice perk.  However, the assignment comes with such responsibility for the citizendry.

San Diego DUI & minors and those under 21 years old

There is no way around it.  A San Diego DUI for someone under 21 years old is tough.  To begin with, there is a one year driving ban.  So many people under 21 need their cars to go to school and/or work.  I can tell you I have had just as many clients who went to Grossmont, Mesa, Cuyamaca, Palomar, as much as the others.

Why should I hire a DUI defense lawyer if I can get a public defender for free?

This is a question that our San Diego law firm gets asked a lot, and for those who aren't familiar with the criminal court system, it makes total sense. Why would you want to pay for something that you can otherwise get for free?

Jose Canseco daughter arrested for DUI

When someone gets a San Diego DUI, it is usually not plastered on the
news unless someone has been harmed. However, as soon as a celebrity obtains a San Diego DUI, everyone hears about it. Well, another celebrity has obtained a DUI this
month. Even if Josie Canseco does well on the field sobriety tests it
is reported that the case is at the District Attorney's office to determine
whether formal charges will be issued.

The firm welcomes its newest member Emiliano Padron

The Law Offices of Mark Deniz is proud to announce the addition of Emiliano Padron to the team.  Emiliano is just finishing up the paralegal program at the University of San Diego (USD).  Law firm owner Mark Deniz states, "Emiliano has been thrown into the fire and has been handled them well. His ability to grasp the concepts of criminal law so fast has been impressive".

Should police officers be allowed to view footage from their body cameras before they write reports for a prosecutor?

This law is well intended.  An officer is involved in an incident that involves an arrest.  The officer writes an arrest report.  In it they describe their observations and base their conclusions on the event.  The report gets submitted.
