First Summer for San Diego Police using Body Worn Cameras

The body camera is good for everyone. It records what is actually happening and not someone's impression of what happened. As a former Prosecutor, I can tell you without a doubt when in the trial the jury usually believes the officers. The camera will no doubt be beneficial for citizens who had a different perspecitve than the officers.

We are all in the thick of the holiday season. The San Diego Sheriffs are very active in the area for DUI and will conduct San Marcos checkpoints or San Marcos saturation patrols often. I was a prosecutor during the Occupy movement in San Diego.  There were some issues that the police oversight took note of.  It is imperative there is civilian oversight.  You know...the people who represent who writes the checks for the police.  The taxpayers demand bang for the buck.  We expect a professional police force.

I told my wife I reviewed all my arguments with her in the last few years and I determined I was justified.  Really?  The District Attorney is supposed to independently review the cases and not have a conflict of interest?  Like the attorney in the article said this is the people they work with every day.  Some DAs work more closely with police than other attorneys in the office.  The DAs office is part of law enforcement.  

When to take a San Diego DUI to trial

The case below was meant for jury trial.  This is a case were the hat is off for the defense attorney because he won.  His case was agreed to by the jury.  It is likely his analysis of the facts were reasonable and the prosecution could not prove their case.  What this means is the government was seeking more punishment than needed.  Is that a bad thing?  Should the prosecutor over-reach?  Should they consider court resources?  It is an argument that can be very interesting and very passionate on both sides.  I will say it is much easier for a prosecutor to say they wanted to be tough.  

San Diego Police Need To Improve Evidence Procedures

I was reading a recent article where a grand jury claimed the SDPD evidence procedures fall short of standards.  Evidence is probably one of the defense bar issues in cases.  In most cases, (especially DUIs) the production of evidence is not presented in full but trickles in.  It is a tough situation because at the same time the court and prosecution want the case to resolve but defense has not completed the examination of the evidence because it is trickling in.  Sometimes the evidence comes in so late the proseuction no longer is making the early case offer even through no fault of the client or defense.  It is a tough situation.

El Cajon police sanctions store for selling alcohol to minors

These stores are charged with a hefty fine for selling to a minor.  What is interesting is that when I was prosecutor I found that a lot of people were buying alcohol from different establishments than liquor stores.  People buy beer and alcohol in larger quanities from Rite Aid,  CVS, target, and other places.  Is ABC going to these locations?  It is easy to target a liquor store.  How about a bigger store. The employees working cashier at those locations are less concerned about IDing people than a liquor store.  I would just hope they investigate fairly.  This includes big stores which sell alcohol in larger quanities (cashes and larger hard alcohol bottles).
