Not all San Diego DUIs are equal....Aggrevating Factors

Not all DUIs are equal.  There is alot of people who just see their BAC number and assume the punishment is set.  I have heard some people come in and say, "my BAC is .24%.  I heard my friend say I am set to pick up trash for aa few days".  In some cases the BAC number is the defining record.  However, in the case above the person had hit multiple vehicles and was belligerent to police.  I informed her picking up trash a few days with those facts might be a tall order.  They could not get over the fact that their BAC was the same as the other person.

San Diego Police to Launch Teen DUI Awareness Program

I actually like the program. So often people feel they are less impaired than they really are. People do not realize they are impaired until they are driving. Some pull over (sometimes too late). Other times people feel they are on the way home and can soldier through. The program will provide context for the young people on how sublte the clues the police see to make the arrest.  When I was a prosecutor and went to my first checkpoints I was expecting falling down drunks.  I was watching someone who I thought was doing well get arrested. Del Mar interestingly is the border between San Diego DUI cases that get directed to the Vista courthouse or downtown to San Diego.
