The hidden consequences of DUI conviction in San Diego

You may know all about the possible penalties that are handed down when a person is convicted of a DUI. In California, a first-offense drunk-driving conviction carries some strong penalties, including jail time and heavy fines, as well as the loss of driving privileges. Recent laws makes it beneficial for people to expunge their cases

A new law in California that took effect January 1, 2014 - Senate Bill No. 530 (SB 530) - provides significant new protection to ex-offenders who committed crimes, including felonies, when it comes to job hunting and what employers can legally discover or use. The new law prohibits an employer from asking about, seeking, or utilizing criminal convictions that have been judicially set aside. Employers violating the new prohibitions can face civil penalties and even misdemeanor criminal charges if done intentionally. It also allows a convicted person to get a case expunged sooner. 

San Diego Police Use Facial Recognition Software

So whats the big deal with a picture?  The officer contacts a person and asks them to hold still.  In the meantime, the person has to wait while the officer is processing the information.  The person must remain level.  If they look nervous they must have done something wrong.  If the poerson is agitated it may raise the level of fear in the officer who would react.  

MADD & San Diego DUIs

One of many questions I get from clients is, "what is the MADD term"? If you are sentenced to a San Diego DUI or a related charge, one of your terms will likely be to attend a MADD victim impact panel.  It is usually a term that is on all DUI related charges (even on Wet Weckless).  It is a term of a DUI resolution that most attorneys do not try to eliminate it our of an agreement.  So, what is a MADD meeting?

San Diego Police Department Class to Show DUI Checkpoint

I actually like the program. So often people feel they are less impaired than they really are. People do not realize they are impaired until they are driving. Some pull over (sometimes too late). Other times people feel they are on the way home and can soldier through. The program will provide context for the young people on how sublte the clues the police see to make the arrest. When I was a prosecutor and went to my first checkpoints I was expecting falling down drunks. I was watching someone who I thought was doing well get arrested. The police note little actions that they conclude is due to impairment. Forget it could be bad balance, sleepiness, being scared to death, etc. DUI checkpoints are a main subject of conversation in in DUI defense. It is good to see the police trying to be proative with teens 

Making sure you can do all you can do on a San Diego DUI

As a former prosecutor handling negotiations with defense attorneys I can tell you very few of them make sure everything that can be done for a client is.  The reality is not every case is going to be dismissed.  Not every DUI arrest will turn into a "Wet Reckless".  A good defense ensures the government can prove their case and the sanctions are reduced as much as can be.  In a good DUI defense there is a lot of little things one can do to make the situation the best as possible for the client.  Some of these include:
