Hiring a DUI Lawyer Attorney in San Diego. Not all DUIs are alike Part 1. Should I hire a DUI attorney?

I was asked this question when I was a prosecutor.  I field calls from people who are on the fence about getting a private attorney or trying to go with a public defender.

One of the biggest reasons people say are inclined to go with a public defender because they saw their blood alcohol level and believe a DUI is a DUI.

I get that sentiment.  A lot of people know they made a mistake of judgment.  They think the court/prosecution is going to be fair to them because they have never been in trouble and they are a good person.  Their particular facts do not look like they can get a "wet reckless" from talking to some other attorneys.  I hope to point out some reasons someone may want to consider obtaining a private attorney. 

The main reason is that not all DUI penalties are alike. The sanctions that come with a DUI charge can vary depending on an examination of the facts and the attorney advocating for them.  There is some terms like the fine that remains the same.  Someone usually has to attend a one night MADD meeting.  Even if the charge after litigation and examination still ends up with a DUI charge, the penalties may be so lessened as to make it worth representation.  The focus on this article is DUI Programs.

Most alcohol related offenses are going to require a DUI educational course.  In most instances you are going to need to complete the course to get your drivers license privelege restored.

One of points of negotiation in a DUI case here in San Diego is what DUI education course someone has to end up with.  Sometimes the case resolves because the prosecutor and court stipulate and the person can attend the 3 month class instead of a 9 month class.

Now, if you are on the outside you think a DUI is a DUI.  Well, that is not true.  If someone can get a 3 month course instead of a 9 month course you are not only saving about six hundred dollars, you are saving your client SIX MONTHS OF DUI COURSES.  That (to me) is huge.  Here is a breakdown of the DUI education programs with some of the costs (approximate)

SB1176 Wet Reckless - $299

12 week program.

6 Alcohol Education Sessions.

(Absences Allowed = 2 consecutive or 3)

AB541 Level I 3 Months - $550

10 - 3 hour Alcohol Education/Group Sessions, one per week.

3 - 15 minute (minimum) Face to Face Meetings with a case manager.

6 Self-Help Meetings

(Absences Allowed = 5)

AB762 Level II 6 Months - $900

15 - 2 hour Groups Sessions, one every other week.

13 - 15 minute (minimum) Face to Face Meetings with a case manager, one every other week.

6 - 2 hour Alcohol Education Classes.

26 Self-Help Meetings

(Absences Allowed = 7)

AB1353 Level II 9 Months - $1,178

22 - 2 hour Group Sessions, one every other week.

19 - 15 minute (minimum) Face to Face with a case manager, one every other week.
