San Diego City Attorney establishes new sentencing policies for San Diego DUIs by integrating Ignition Devices (IID) for more cases

by | Nov 3, 2013 | DUI Cases |

As of November 1st, the San Diego City Attorney’s Office is coming out with new sentencing policies for DUIs prosecuted by their office. The San Diego City Attorneys prosecute all DUIs in the limits of San Diego (and Poway). On first time DUIs with BAC levels .15% and higher they will require an ignition interlock device for one year.

This new City Attorney policy will be a tremendous hardship for persons accused of DUI. Solid representation will become even more important. The weight of a DUI conviction is heavier now than ever before.

The new policy is more strict that the current guidelines.  The San Diego City Attorney’s office (who focuses only on misdemeanors) is skilled at DUI prosecution. Rarely would the prosecuting agency ask for an ignition interlock, even for multiple DUI offenders.

The ignition interlock device must be installed on every vehicle the offender owns and operates. The IID can costs thousands of dollars per year. You must blow into it to start your vehicle and it will randomly require a sample during the driving in order to not lockout the driver.  This is in top of SR 22 insurance (see my website for details).  The hidden costs of DUI is immense!

As a former City Attorney and prosecutor for 10 years, I can tell you this policy has given the prosecution a major advantage in DUI litigation. Getting this device off the table is the first step in a competent DUI defense.  It is key that you hire
the best locally experienced criminal defense attorney to represent you that
you can afford. You should obtain a free consultation as soon as possible after a DUI arrest.  It is vital to be proactive.
