A San Diego DUI focus on Drunk-driving penalties by state

by | Feb 17, 2014 | DUI Cases |

What will happen if you’re pulled over for drunk driving? All 50 states and the District of Columbia have laws that define a driver with a blood alcohol concentration (BAC) at or above 0.08 as legally drunk. Typically, license suspension or revocation follows a conviction for drunk driving. There is a push that the legal limit may go down to .05%,  In addition, some states impose an administrative license suspension, where licenses are taken before conviction when a driver fails or refuses to take a chemical test.

After a conviction, more than half of all U.S. states permit offenders to drive only if their vehicles have been equipped with ignition interlocks, which analyze a driver’s breath and disable the ignition if alcohol is detected. There are a few counties which make an ignition interlock (IID) mandatory after a first time DUI conviction.  San Diego DUIs will typically not   require an IID unless there are certain facts or the blood alcohol level is .15% or greater.    Here is a state by state breakdown of license suspensions as a result of a DUI.

License suspension is one of the most severe consequences of a San Diego DUI.  Since the suspension is through the DMV (and thus civil), someone going through a Public Defender will not have an attorney navigate them through the process.  People need to work, go to school, and transport their families.  Santee, La Mesa, Carmel Valley, and other locations is where several call home.   Part of my job is ensuring not only obtaining the best resolution for my client, but it is navigating them through a very complex process.  I want them out of the DMV and court system as soon as possible.  I then set early probation termination of probation (if they have it) and then expungement.  The information above illustrates a sliver of a consequence of a San Diego DUI.

Hire a Proactive, affordable, and quality defense when you are facing San Diego DUI charges.
