SDPD San Diego Police Officer Resigns After Filing Claim Against City Attorney

It seems like police are leaving the agency in numbers.  It is interesting because I remember Moncrief’s name on the thousands of cases I handled when I was a prosecutor.  We as a society place great power in the hands of our officers and it bears a great responsibility.  I hope whatever the result is going to be will be just.

A San Diego Police officer once accused of sexual misconduct has left the department, officials confirmed Tuesday.

Officer Donald Moncrief, 39, became the center of a District Attorney’s Office investigation after a woman claimed he touched her inappropriately and exposed himself to her when he arrested her in Otay Mesa in 2013 for stealing a vehicle.

The SDPD soon placed Moncrief on paid leave as internal affairs looked into the accusation.

However, the DA’s office decided not to file charges against him because investigators had insufficient evidence.

In late April, Moncrief filed a claim against the city and the SDPD for unspecified damages, accusing them of violating his rights under the Public Safety Officers’ Bill of Rights.

He is also seeking damages for defamation and intentional infliction of emotional distress against those who disclosed his identity and private information when the allegations first came to light.

The claim requests compensation for lost wages, attorneys’ fees and costs, pain and medical expenses related to therapy he and his family have had to undergo since the allegations arose.

When the claim was first filed, SDPD and city attorney’s office officials said they cannot comment on pending legislation.
