4th of July “Be Safe” Primer here in San Diego. Know your rights. Know your responsibilities.

On Behalf of | Jul 3, 2014 | Firm News |

4th of July is nearly upon us.  It is a good time to be prepared and be safe.  If you are arrested for a San Diego DUI it is too late.  Here is some tips and previous articles to assist in making sure you are not arrested for a San Diego DUI this weekend, this summer, or in the future.

1. If you drink do not plan on driving.  It just is not worth it.  A cop stop you and you admit to one or two beers.  They smell the alcohol on your breath.  You will be likely arrested and even if there is no charge…the car is towed, your license is taken away, and you went to jail and had to bail out.  This would be a GOOD result.  Just plan on not driving if you drink.  Uber…a designated driver….crashing at a house.  Something other than drinking and driving.

2. Know your rights.  Use em.  Everyone is a big talker about what they would say if stopped.  All that goes out the window when it is them.  They either want to be compliant to the officer or think they can rationalize with the officer.  NOPE.  The only true way is to utilize your constitutional rights.  Commit the following to memory.

3. If presented with a choice during a San Diego DUI situation…… take the Blood test.  I explain why here.

4. Unless you are on probation or under 21….refuse the PAS test (hand held breath test).  Here is why.

Finally….have a safe 4th of July.  Let us remember that people hundred of years ago rallied to make a stand to be free.

These were regular folks who wanted a better lives for themselves and their families.  Their battle against the greatest empire in the world at the time eventually led to our constitution, which is the greatest document of freedom ever drafted. These people came together and made a pledge to each other.  They established a government that made a pledge to them.

We the people of the United States, in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution for the United States of America.

Let us always keep steering the ship down this path.  Have a safe and Happy 4th of July.
