I was reading an article the other day stating the San Diego Sheriff's will FINALLY be implementing Body Worn Cameras (or BWCs). This is a huge deal for attorneys that practice DUI defense. BWCs are an invaluable tool in examining the integrity of the DUI investigation. This is especially so in North County San Diego, where the Sheriff patrol a large part of the area. Importance of Body Cameras
When I began practicing years ago as a prosecutor, the defense was examining primarily the police reports, calibrations, and other paper documents. Attacking the credibility of a DUI investigation was about seeing the facts and seeing there was a disconnect in the evidence. Explaining a scientific or very detailed mistake was sometimes complex and jurors often chalked it up to "defense tactics". Video evidence is key. The reality is police are often not sufficiently trained in DUI investigations. The officers may know what to do, but they do not know "why" they are asking a particular question or administering the test. What happens is they often cut a corner in a particular test to save time. That small change contaminates the integrity of the DUI investigation. Video evidence is key because the officer will get on the stand and say they administered a test according to their training. However, the next witness is the prosecution's expert, who will watch the video and have to concede the test was done incorrectly. Seeing mistakes in the DUI investigation right there on video is a solid way to begin getting better resolutions.

A significant portion of our firm's practice is in North County. With agencies, such as the CHP, Escondido PD, Carlsbad PD, we can review body cam video. The San Diego Sheriff patrol a large part of North County. This includes San Marcos, Vista, Encinitas, and others. It was a shame when I got a client from a Sheriff area because it took away a valuable tool to examine the evidence.
Being Proactive is Key
When our firm begins a DUI Defense, we want our hands on the video, police reports, and lab evidence BEFORE the first court date. DUI arrests are set out six weeks or so. You want to use that time to your benefit. This requires subpoenaing the police agencies. I know our firm has reached out to the Sheriff's to find out how to obtain the videos via DMV subpoena. As soon as the BWCs come out for the Sheriff's, we will be serving the subpoenas to begin an examination of the evidence.
This is part of a proactive defense, which ultimately, will put someone in the best position to get the best results possible.
The BWC is a valuable tool for DUI investigation. I am very glad the Sheriff's Dept is implementing the device. It will go a long way to ensure justice for North County persons accused of DUI.
