Importance of Body Cameras
When I began practicing years ago as a prosecutor, the defense was examining primarily the police reports, calibrations, and other paper documents. Attacking the credibility of a DUI investigation was about seeing the facts and seeing there was a disconnect in the evidence. Explaining a scientific or very detailed mistake was sometimes complex and jurors often chalked it up to “defense tactics”. Video evidence is key. The reality is police are often not sufficiently trained in DUI investigations. The officers may know what to do, but they do not know “why” they are asking a particular question or administering the test. What happens is they often cut a corner in a particular test to save time. That small change contaminates the integrity of the DUI investigation. Video evidence is key because the officer will get on the stand and say they administered a test according to their training. However, the next witness is the prosecution’s expert, who will watch the video and have to concede the test was done incorrectly. Seeing mistakes in the DUI investigation right there on video is a solid way to begin getting better resolutions.

The San Diego Sheriff patrol a large part of North County. This includes San Marcos, Vista, Encinitas, and others.
