The city of Escondido is one of the more interesting towns in San Diego to receive a DUI because the facts of each case may be totally different from the other.
Escondido has SR-78 and I-15 in its borders. Both of these freeways have a very intensive police presence. A person can come in contact with Escondido Police just as easy as the California Highway Patrol (CHP). Someone can also come into contact with Sheriff Deputies. All these agencies are sniffing for DUIs. More Escondido residents will be suspected of DUI even when they not be. Call the Law Offices of Mark Deniz now for a free consultation at (858) 751-4384.
In these “saturation areas,” it is key that you are aware of your rights. First, be suspect of traffic stops in the late evening because this is the probable cause (PC) the officer pulls you over. It is often very minimal and if you are not DUI you need to fight the citation.
Escondido has some differences
I have an office in Escondido and deal with many cases in the area. I also have experience from my almost 10 years as a prosecutor. You have to look at the little differences in a case.
Escondido Police have body-worn cameras (BWCs). This evidence is key when examining what actually happened in the case. Police often use templates when fillling out reports. These reports do not always reflect the facts of the case. The videos are much better in determining what is true. The reports may have someone with slurred speech, unsteady gait, etc. However, when you turn on the video there is none of that.
Do not wait to get this evidence. You can get it usually through the DMV hearing. It is key you become proactive and get evidence as soon as you can.
Second, if you are stopped by police. Be respectful, but know if the officer suspects DUI than he will likely arrest. Here are some likely observations they would use to form their opinion:
– Any kind of bad driving
– Red, watery eyes
– Slow movements (funny…who wants to make fast movements with police)
– Odor of alcohol
– Slurred speech
The best route is to be respectful but STAY quiet.
Tell the officer you do not want to make any statements. Tell the officer you do not want to take any tests. Tell the officer you do not want to take a breath or blood tests UNLESS YOU HAVE TO.
The officer may still arrest you, but your case will be in a much better situation.

A little about the city of Escondido
Settled in a long valley in the coastal mountains of Southern California, Escondido, which means “hidden” in Spanish, lies about 18 miles inland, 100 miles south of Los Angeles, and 30 miles northeast of San Diego. Surrounded by avocado and citrus groves, Escondido is a diverse, vibrant community with just the right mix of small town friendliness and big-city buzz.
More and more people are making Escondido their “City of Choice.” As the heart of San Diego North, it is one of the few remaining communities where people of all income levels can enjoy the Southern California lifestyle. We offer attractive homes in a wide range of prices, two lakes, several parks, a sports center, golf courses, restaurants, wineries, shopping centers, comprehensive healthcare and the nearby San Diego Zoo Safari Park. In addition, the California Center for the Arts, Escondido, brings world-class entertainment to the area along with Queen Califia’s Magical Circle, a sculpture garden in Kit Carson Park donated by late internationally renowned artist Niki de Saint Phalle. In recent years Escondido was named by Money Magazine as the Best Place in the West in which to retire and, at the other end of the spectrum, was named a Kid-Friendly City for our broad range of youth programs. Ladies Home Journal also ranked Escondido number eight among the Top Ten Cities for Government.
Established in 1888, the city’s rich past brings charm and stability to the community. You can see it in the historic homes of Old Escondido or experience it in the thriving downtown area and the weekly blast to the past, “Cruisin’ Grand.” Yet integrated with Escondido’s treasured heritage is a progressive future, bright and brimming with promise. New jobs, new cultural amenities, new entertainment venues, new choices for residential living, and a new vision for Escondido’s future, make Escondido a city to watch.
