Driving

In order to convict you of driving under the influence, the prosecutor must prove the following two facts (otherwise known as “elements of the crime”):

  1. that you drove a motor vehicle, and
  2. that you were under the influence of alcohol at the time you drove.

Driving means, “any volitional movement”.  This could be a few inches.  For example, a person is leaving a sports bar.  As he leaves he reversed the car and bumped the car behind them.  There was NO damage to the car, but merely one of those bumps because you backed up five inches. The other guy with the car looked at it and was fine.  However, someone called police.  That small movement can potentially constitute a small movements for purposes of a San Diego DUI.
